Canada Outlines 15 Categories Eligible for Open Work Permits Without Prior Job Offers

The Canadian government has outlined the specific categories of individuals eligible to secure an open work permit, giving foreign nationals the ability to accept employment with nearly any employer across the country without first securing a job offer.

Unlike a standard closed work permit, which binds a worker to a single employer and position, an open work permit offers broad employment flexibility. 

According to guidance from Immigration, Refugees and Citizenship Canada (IRCC), employers hiring open work permit holders do not need to conduct a Labour Market Impact Assessment (LMIA), submit a formal offer of employment through official government channels, or pay the standard employer compliance fee.

However, restrictions remain in place. Permit holders are strictly prohibited from working for employers listed on the federal government's non-compliant list, as well as businesses that regularly offer striptease, sensual dance, companion services, or sensual massages.

Key Eligibility Categories for Applicants

Federal authorities clarified that individuals applying from outside Canada generally do not qualify for an open work permit, as the majority of eligible applicants must already reside within the country at the time of application.

Eligibility is restricted to 15 defined streams spanning student pathways, family connections, vulnerable populations, and specialized categories:

• Students, Graduates, and Youth: Candidates applying for a Post-Graduation Work Permit, individuals under the International Experience Canada Working Holiday stream, destitute students, and recent graduates from Hong Kong.
• Spouses and Dependent Family Members: Family members of permanent residence applicants, family members of existing work permit holders, spouses and common-law partners of international students, and sponsored family members.
• Vulnerable Groups: Recognized refugees, asylum claimants, protected persons, victims of workplace abuse, and individuals impacted by crises.
• Specialized and Other Streams: Indigenous Peoples, general permanent residence applicants, Temporary Resident Permit holders, and qualified Quebec investors.

Important Restrictions and Application Guidelines

Officials emphasized that obtaining an open work permit does not grant unconditional employment rights. Sector restrictions regarding non-compliant employers and adult services apply across all 15 categories regardless of how an applicant qualifies.

Furthermore, meeting the eligibility criteria under a specific category does not guarantee automatic approval. Applicants are encouraged to verify their exact classification and ensure all criteria are met before submitting an application to IRCC.
